Please read the following terms and conditions carefully before using or installing this NEITRA 3D PRO. Your use or installation of this copy of “Neitra 3D Pro” indicates your acceptance of this License. If you do not accept the terms of this agreement, do not install or use the product; promptly return the product to the place you obtained it.
DEFINITIONS
1. Triayaam means Triayaam Vision Labs Pvt. Ltd.
2. Neitra 3D Pro means the software product.
3. SOFTWARE PRODUCT here means Software (computer program), software updates, image files, all accompanying files, data and materials received with your order of “Neitra 3D Pro”.
If you do not agree to any of the terms of this License, then do not install or use the NEITRA 3D PRO. If you have purchased a single copy from Triayaam or an authorized distributor, reseller or any retail channel, you may return it unused, within thirty (30) days after purchase, for a refund of your payment less any incidental charges. The 30-day warrantee is applicable only to products bought within India. Products downloaded to or shipped out of India are strictly non-refundable.
COPYRIGHT/PROPRIETARY PROTECTION
The Product is owned by Triayaam and is protected by Indian and international copyright laws and international trade provisions. You must treat the Product like any other copyrighted material. This license and your right to use the Product terminate automatically if you violate any part of this agreement. In the event of termination, you must immediately destroy all copies of the Product or return them to Triayaam.
LICENSE GRANT
a) This Neitra 3D Pro is for personal use only and may be installed and used by on only one computer. Its component parts may not be separated for use on more than one computer. All components accompanying the software are copyrighted by Triayaam and may not be taken apart, modified, used or published with other software or means except with the Neitra 3D Pro software and may not be distributed or copied in any manner.
b) Triayaam grants you a non-exclusive license to Make one copy of the Software for archival purposes, or copy the Software onto the hard disk of your computer and retain the original for archival purposes.
c) After written notification to Triayaam and subsequent approval in writing by Triayaam, transfer the entire Product on a permanent basis to another person or entity, provided you retain no copies of the Product and the transference agrees to the terms of this agreement.
For the purposes of this agreement, “use” means loading the Software into RAM, as well as installation on a hard disk or other storage device (other than a network server). You may access the Software from a hard disk, over a network, or any other method you choose, so long as you otherwise comply with this agreement.
You may not:
a) Copy the Documentation other than as part of the standard installation of the Product on one computer.
b) Modify, translate, or merge the Software with another program, except for your personal use on a single computer. Any modifications to the Software are subject to this agreement.
c) Reverse-engineer, disassemble, decompile, or make any attempt to discover the source code of the Software.
d) Sublicense, rent, or lease any portion of the Product.
e) Use the previous version of the Software that has been upgraded or updated under this agreement. Upon upgrading or updating the Software, the old copy must be deleted from the computer.
f) Make access to NEITRA 3D PRO available to others in connection with a service bureau, application service provider, or similar business, or use this NEITRA 3D PRO in a business to provide file compression, decompression, or conversion services to others.
LIMITED WARRANTY
Warrantee covers defects in the software, which prevents successfully installing the software in the buyer’s PC and that the Software will perform substantially in accordance with the Documentation for a period of 60 days from your receipt of the Product. Warrantee does not cover fitness of purpose, not meeting of expectations or needs in the mind of the buyer.
Any written or oral information or advice given by Triayaam’s dealers, resellers, distributors, agents, or employees will in no way increase the scope of this warranty.
If the Product fails to comply with the warranty set forth above, Triayaam’s entire liability and your exclusive remedy will be at Triayaam’s option, triAyaam’s reasonable effort to make the Product meet the warranty set forth above.
This limited warranty applies only if you distroy all copies of the Product and deregister the license provided to you within 60 days of the date you received the Product.
If Triayaam is unable to make the Product conform to the above warranty, Triayaam, at its option, will refund all or a fair portion of the price you paid for this package.
Any replacement Software will be warranted for the remainder of the original 60-day warranty period or for 30 days from the date you received the replacement, whichever is longer.
TRIAYAAM DISCLAIMS ALL OTHER WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO THE PRODUCT. THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS. YOU MAY ALSO HAVE OTHER RIGHTS.
NO LIABILITY FOR CONSEQUENTIAL DAMAGES
In no event shall Triayaam or its suppliers be liable for any damages whatsoever (including, without limitation, damages for loss of profits, business interruption, loss of information, or other pecuniary loss) arising out of the use of or inability to use the Product, even if Triayaam has been advised of the possibility of such damages. You are solely responsible for the selection of this Product to achieve your intended results and for the results actually achieved. You also accept the entire risk as to the quality and performance of this Product (including but not limited to errors and/or interruptions in operations). Should this Product prove defective in any way then you assume the entire cost of any necessary corrective actions. You are advised to test the Product thoroughly before use for your particular purpose. Because some jurisdictions do not allow the exclusion of implied warranties or the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you. The foregoing limitations of warranty and liability inure to the benefit of Triayaam’ licensors having an interest in the package.
In addition, in no event does Triayaam authorize you to use this NEITRA 3D PRO in applications or systems where NEITRA 3D PRO’s failure to perform can reasonably be expected to result in a physical injury, or in loss of life. Any such use by you is entirely at your own risk, and you agree to hold Triayaam harmless from any claims or losses relating to such unauthorized use.
GENERAL
This Agreement constitutes the entire statement of the Agreement between the parties on the subject matter, and merges and supersedes all other or prior understandings, purchase orders, agreements and arrangements. This Agreement shall be governed by the laws of INDIA.
Triayaam the owner of the copyright of this NEITRA 3D PRO, all of its derivatives, title and accompanying materials are the exclusive property of Triayaam. All rights of any kind, which are not expressly granted in this License, are entirely and exclusively reserved to and by Triayaam.
You may not disclose to other persons the data or techniques relating to this NEITRA 3D PRO that you know or should know that it is a trade secret of the Triayaam in any manner that will cause damage to Triayaam.
This NEITRA 3D PRO and all services provided may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any Indian, State or City law is strictly prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. You agree to indemnify
and hold Triayaam harmless from any claims resulting from the use of this NEITRA 3D PRO, which may damage any other party.
